Mediation / Hearing

My ex-wife filed a motion for an OSC to modify visitation/custody & child support. I have sole legal custody of my children. She made accusations during mediation of child abuse by me and my current wife (UNTRUE)The mediator requested to speak with the children. After speaking to my children the mediator recommended my ex have supervised visits. Went it was time for the hearing my ex postponed for another week due to the outcome of mediation so she can get an attorney. The mediator found the children to be safe and well taken care of and found no signs of the accusations made. Since my ex wants an attorney should I also get one. It's been pro per as of late? I know my ex wants to attack my wife verbally in court and is dead set on making my current wife look bad.

In any contested custody case you should be represented by an attorney.

You are going to court for custody of your children. If there is an attorney on the other side then beware - it is most likely the attorney knows more law than you and is more used to dealing with the court system.

If you can afford an attorney then you really should have one. Sometimes one's failure to pay legal fees can be false economy. If you go to court in pro per and the orders are not in your favor, then it far more difficult and expensive to repair the damage - the old maxim is true, to wit: an ounce of prevention is better than a pound of cure.

You may find that although it looks as if you have a good recommendation and promising, the mother's attorny may effectively examine the mediator and put doubt in the judges mind regarding the recommendation. Please call me directly at (619) 222-3504.
