There is no hard and fast rule on a custody determination concerning a move away case. The court must determine the best interests of the children in assessing their placement. While it is safe to say the less time the non custodial parent has with the children the greater are the chances that the court will allow the primary caregiver to relocate with the children, there are no guarantees this will be your outcome.
