Mediation recommendation, I am not agreeing with

What can I do to go against what the mediator is recommending to the courts, that I do not agree with?

The recommendation is not binding on the court and is only a recommendation. Some judges are more likely than others to vary from the recommendation which is why you are better off with an attorney who is familiar with the judge and can emphasize the areas which are most imporatant to you and which are most likely to sway the judge. You should file a declaration with the court explaining the factual errors, if any, and why the recommendation will not work for the best interest of the child in your particular situation. Retain counsel to represent you and argue for you. Prepare a declaration re points not agree with and if have additional proof the mediator is not correct, add the proof. Medidators do have great influence on the judge's decision so it is important to be prepared. Don Holben 800-685-6950
