Mediation vs. separate attorneys

Not sure what to do here. Husband &

I have decided to divorce. Based on

history with him I cannot see how

he will play fair, but he SAYS he will.

I am willing to try mediation with

him first IF there is no way I can

somehow get screwed over

unknowingly, but at this point I need

to look out for my best interests.

So... that being said, is there any

reason why he & I should NOT go to

a mediator together to try to work

everything out in a civil fashion?

Would I know right away if he's not

playing fair?

The big thing to understand about mediation is that you waive any attorney client confidences. Therefore once you participate in mediation, things you say there, will be waived if you wish to later claim it as privilege.
