Use of marijuana depends on the individual judge and the individual case. It would be evaluated in the entire context of the case to see what is in the best interest of the child. Usually "softer" drugs like marijuana don't make much impact, especially in light of the new laws regarding decriminalization of marijuana. You should consult a local attorney to see if it would have any impact on your individual custody matter.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
