Legal Question in Family Law in California

Military mom lost custody of daughter

Last week i lost custody of my daughter, I had custody from the age of birth to 4 1/2, and then had to give my ex temp custody while i was in the military service. And then i had her for the last yr. She just turned 7.

The evaluators report was the sole basis for the decision. I did not recieve the report until 6 dys prior to the hearing and this was the last hearing, no more delays. I did not have time to find an expert to go thru the report for any possible objections or complaints against the eval.

The eval. was appointed by the court and I recently found out that the eval. has had 2 prior disapline actions against him. I also found out that he talked w/my exs attorney without me being present on a conference call and stated he would not appear in court unless i paid $3,800, this was not even the amt. in our contract. I could not get a hold of him at all, he never returned my call. This was on Fri., and my hearing on Tues.

I had someone go thru the eval, and we could not believe the bias, methodoligical and procedural flaws. He never interviewed any key players in my daughters life. I had evidence showing my ex was lying, etc.

Could an appeal be in orderor what would be the next step. I have to do it on myself

Re: Military mom lost custody of daughter

Your question is complex and can be responded to only after a review of all of the documents. The time for taking action may well have passed by the time you receive this response. You will have to review the facts of your case with an attorney in the area where the court hearing was heard.
