Minor Emancipation

Do both parents need to sign for this? Has theis ever been used as a way to get custody of a 16 year old minor child.

Neither parent has to sign. The petition for emancipation must be signed by a judge. One of the requirements is that the minor have the ability to support him or herself. The result is that the child is free from the control of both parents. Thus neither parent would have control of the child.
