Legal Question in Family Law in California

Minor moving out with boyfriend

I live in California and I am about to attend college. My girlfriend is 16 and I am 18. She has taken her High School Proficiency test and will be attending college in the fall semester as well. We will be getting married in about a year or so and were wondering if it was legal to move into an apartment together before we were married. She would have parental consent. We would both have jobs and recieve financial aid from our parents. Is it legal to move in together with parental consent while she is 16 and I am 18 without being married or emancipated?

At 18 you are an adult and she is 16, a minor. Minors cannot consent to having sex with an adult. Some district attorneys do not prosecute such cases when the age difference in minimal, two years in your case. There is however, risk that you could be prosecuted for unlawful sex.
