Legal Question in Family Law in California

Minor spelling change in last name

Does change in spelling of a last name, such as Vanallen to Van Allen need legal change? Problem arises with driver lic from DMV since they now cross-check with Soc. Sec. and pick up original spelling of many years ago.

Re: Minor spelling change in last name

No, you could just use the same speling as is on the social security card. If you want to use a new spelling then you will have to have the court make an order changing the legal name.--Atty fees should be less than $1,000 for this relatively simple procedure. However, it will cost you about $700 more for publication and filing fees. Note that there will be some additional fees charged by the state of California to change the name on the birth certificate and by the Social Sec Adm. to change name on Social Sec. Card.
