Modifacation Order For Visitation

my sons father has sole costody of my son but we also have joint too which we were doing ok dicussing things and talking to eachother but then he got a girlfriend and they moved in with her. and she is coming in between my parenting time with my son she refused to let me speek to his father about anything she said to me that he is with her now so she wants us to talk through her my sons not allowed to call me or talk to his dad about me i need to know what papers to file to get it back on calender, how many copys i need, or whatever else i need to do.

Check to see if your court has a family law facilitator who can help you with the paperwork. You will need an Order to Show Cause form and an Application for Order and Supporting declaration. You can put your declaration concerning the problems that you are having on the form, and get additional declaration forms from the clerk if there is not enough room. You should have an original and two copies when you file it with the court. The clerk will keep the original and give you back the two copies that have been conformed, with the time and date of the hearing and your meeting with Family Court Services (mediation). Serve one copy on the father and keep one copy for yourself. You will meet with a mediator before you go to the judge. Good Luck, Pat McCrary
