Modification of child custody and support

I have been divorced for three years and my son lives with me and my daughter has been living with her father. My son is 17 and my daughter is 14. A week ago she wanted to come live with me and it was agreed by her father that she should do so. Unfortunately he will not agree to paying more in child support. I would like to file for a modification of child custody and support. How can I request his income and get support for my daughter who will now be living with me full time?

You would need to file an OSC re: modification of support. This would also require an income and expense statement that would require both of you to list your current income and expense. This information would be used to compute a support number. I would suggest getting an attorney as you may find this process difficult. Good luck.

File an OSC to modify custody, visitation and child support. Then subpoena the other parents wage and payroll records.

You may wish to proceed in a two step process. The first step would be to get custody of your daughter, that is wait for her to move into your home. Thne proceed with the OSC or noticed Motion for an increase in child support.
