modification of existing court orders for child custody

currently there is a court order for child custody between me and my ex-husband,(joint physical/legal with resonable visitation to the father). my children are now living with him and we need to modify the current order to show that this change has occured. both parents have agreed to an arrangement, which forms are required to be filed to change this order? or can a declaration signed by both parents change the order? please be specific as to which forms i will need as I will be completing them myself (in pro per)...thankyou

You need to file a stipulation changing the custody order. Check with the family court regarding a clinic to assist you with the preparation of a stipulation.

You need a Stipulation & Order Re: Modification of Judgment. I do not think there is a judicial council form for this. Our paralegal department does them all of the time for self represented parties.

Whoever does this for you, you will need to provide them with a "conformed copy" of the underlying Order you are trying to modify. Once signed by all parties, it is submitted to the court without the necessity of a court appearance.
