Modification of support and Custody

recent custody battle ended again with me having joint legal /kids live with me in Maryland Dad stationed in Ca.for last 5 yearsthe kids and i lived there for 6 months then seperated moved back east in 2000.supportsplit76/24Dad never comes or uses full amount- claimed alienation at last court Dad since had rarely come less than 2%has gotten 3 pays raises i was imputed with 30000/yr when in the 15 years in marriage never earned it worked p/t at min.we moved every 2 yrs (4 kids all his last one severally disabled)Dad uses his military job as excuse not to see kids(remarried with 2 more now)will not take kids for summer as court ordered or give me $to keep them for the summer(which is what we want) dad claims he'll sue me for full custody again or lower support again if i try to modify-last time he did the same thing when i tryed to modify and the judge almost gave it to him but he backed pedaled because ''the kids are most important''-its all about $ he doesnt want them can i do this w/out an atty.or do past orders stand and if i try i get spanked again?

The best thing to do is to gather copies of all of the orders pertaining to the issues you have raised, and consult with an experienced family law lawyer. These documents need to be reviewed and assessed in order to provide you with specific answers.

Chances are very good that the support order will go up. Unlikely Dad will get kids if he hasn't been seeing the kids. Contact an attorney in the county where orders are currently filed or the county where Dad lives to give you a better idea of what will happen. If either of those counties are San Diego County you may fax me copies of the current order and Dad's rank and number of years in the service and I can give you a good idea of what will happen. If you have an attorney you will not need to travel to California, so may be cheaper to use attorney than to travel. Pat McCrary
