Legal Question in Family Law in California

I am trying to modify my child's name. I want to add my last to her name with the father's surname. We are in the process of divorce and have been married only 2 months. The baby was born 2 weeks before the legal marriage.

The commissioner ruled against my request and denied the name modification. She did not really give any facts or good argument to deny it. She just said that I should have thought in the hospital which name to give and that it is not a standard in the United Stated to do so. She was completely biased.

What can I do now? I ve got a trial coming up.

I have a feeling that there is more to this story than you are telling us. If both parents of the child consent to the name change, this should not have been a big problem.
