Modifying custody

My ex husband has had full custody of our 7 year old son since March 2004. I would like to have him back in my custody because I feel that he is safer in my care since his father is a drug addict. My question is, even though my son is doing well in school and his step mother mostly cares for him, do you think I would have a chance of getting him back? His dad is selling all of their belongings, stealing, and was even fired due to drug abuse.

Child custody orders are never permanent, and are always subject to change as circumstances change. Thus, you would have an excellent chance in modifying the orders so long as you have the factual circumstances to back and support the modification order you seek. As Mr. Torrey stated custody orders can be modified if there is a change in circumstances. In addition to the facts concerning father's current conduct, the facts that led to father being the custodial parent must be factored into the mix. These facts will be extremely important in determining whether custody should be changed.
