Legal Question in Family Law in California

My mom needs psychiatric help. She and my dad are in the process of getting a divorce, but the terms in which they divorce are not fair, in that she had been hoarding 65K for a couple years from his paychecks (which he obviously didn't know about), and she gets most of the money from the divorce as well as some of my dad's pay. My dad has to support me and my brother going to college, etc. I am already 21, and he is going to turn 18 in a couple months. I was wondering how I could possibly legally force my mom to go to court and testify that she is mentally ill? And would proving that she's mentally ill help my dad's situation?

1 Answer from Attorneys

Your mom's mental condition is not an issue in a divorce, unless it affects child custody of your brother until he turns 18. More important is the hiding assets. Your dad needs an attorney if he doesn't have one, and if he does the attorney needs to know what you know about the hidden assets. That has WAY more relevance in Family Court than if she is mentally ill or not.
