Your mother has a right to seek a divorce if she wants one and believes her marriage is no longer salvageable. That decision is up to your mother though. She needs to weigh the pros and cons of staying with a marriage or leaving it. With that being said the legal remedies she has available are hers to choose from. She can ask that he be removed from the house, its usually a wise thing to do since the stress of a divorce and living in the same house is too much for most people to bear. Please ask her to speak with a local attorney to assist her in this process.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
