Legal Question in Family Law in California

does mom stand to lose parental/visitation rights?

My 12 yr old child is now living with my ex-husband, we had the paperwork changed in court to show that ex-husband is primary residence parent; however, we have joint custody. Ex-husband wants to move to Nevada from California. Do I, as the child's mom, stand to lose any parental rights or visitation rights if my child indeed moves? Please advise! Thank you

The mere fact that the child moved to Nevada would not cause you to lose your visitation rights. The problem will be transportation of the child to and from the visits. You should insist that arrangements be made for your continued contact with your child. One thing you might want to do is request that he have high speed internet access and a video camera, then you would do the same. This would allow you and the child to see each other. Also you should request that child support reflect the costs of visitation. In cases such as this setting visitation so that you get the child during the summer and vacations.
