Legal Question in Family Law in California

Mom wants visitation with kids after 6 years of no contact

My divorce and custody of my kids was all done in California. We all live in Nevada now. My ex-husband and I were ordered joint custody he got full physical custody. I have not had any contact with these kids in 6 years. I want to get back into their lives. What steps should I take to get some sort of visitation going.

You will need to file for an order in Cal letting you file in Nevada. The court here can make an order that since none of the parties live here any more, child custody may be modified in another state. Contact me if you require further assistance

If possible obtain a certified copy of the California custody order. You should file the appropriate paper work with the Nevada Court. Since both parents and the children are in Nevada the court there has jurisdiction. You would not need permission from the California court.

I disagree with the Calif. lawyer. I believe that since everyone lives here Nevada will assume jurisdiction without further Calif. orders. You would need to localize the Calif decree and file a Motion for custody and visitation. We have mandatory mediation in Las Vegas which may allow you to resolve this without the Court making a schedule for you. You would need to explain why you have waited 6 years to enforce your rights.
