Legal Question in Family Law in California

Monitored visitation question

Fianc leaves in LA, CA and his sons reside in Alhambra,CA area. He was awarded monitored visitation. We printed local offices from courthouse web site. Called each one and left messages. The first to return his call was located in Pomona. He meet with them on Monday, November 8, 2006, paid the fee and a letter of notification was sent from L.A. Wings of Faith to his ex-wife requesting she call for her meeting. Instead of going to them she went to another facility, which is the same distance from her home per map quest. Fianc just received a call from that facility letting him know that she went to them yesterday Thursday, November 16, 2006 and he needs to set up a meeting with them and repay the fee. He explained to them she was supposed to go to the one the letter came from and said he would call them back. Can they make him go to them (they said they cant even see him until after the Thanksgiving Holiday)? He wants to see is Boys. This is just another delay:( Should she have gone to L.A. Wings of Faith'' where the letter came from that initiated her meeting? Does he have a foot to stand on if he tells them she has to go to L.A. wings of Faith instead of reverse? Help! What should he do?

Thank You

Re: Monitored visitation question

The answer to your question depends upon several factors. First what does the court order provide in regard to selecting the supervisor. Second are there factors other than distance from her home that would be affect the visitation. Traffic in the area is one factor. The location of the child's school or daycare facility and the visitation location. His work and home location and travel time would also be factors to be considered.

In cases such as this it often best to work at coming to an agreement. He can use this incident to his advantage, by showing that his is willing to cooperate and she is interferring with his visitation. If the original supervisor agency will refund he payment then he should seriously consider changing locations.
