Legal Question in Family Law in California
My mother attempted to take my daughter from school yesterday, she wasn't permitted by the staff. My husband sent my mother a message stating that he thought her actions constituted attempted kidnapping and that she was not to attempt to contact my daughter in any manner. Aside from the problems this creates for me and my demolished relationship with my family, what can I do to protect my daughter from another attempt? I don't know if a restraining order would be granted or if it is warranted. I also really don't want to have my mother arrested. She needs psychological help but refuses to admit she has a problem.

While the staff may be able to prevent your mother from picking your daughter up with their compliance, if you are concerned that she may hang out at the school waiting for an opportunity, or if she encounters her off campus, it would seem that a restraining order is in order. I understand you feel sorry for your mother, but she is not your responsibility. Your daughter IS your responsibility.
