If the mother wants to a child support case just because the father does not want to be with her & just wants to be with his daughter. Will the state of California rule in her favor & he won't be able to see the baby & spend time with her whenever the fathe

Child support and child custody and visitation are two separate legal issues. Also, if the child is receiving public welfare benefits, the issue of proceeding with a child support case is not the mother's choice but rather a condition of eligibility for receiving such assistance. As the support must be paid, especially if paternity has been established, a non-custodial father should take legal steps to establish a joint legal custody order and a visitation plan in order to maintain contact with the child.
