Legal Question in Family Law in California
The mother of my child is wanting to take me to court for back daycare expenses dating from 2007-2009. I signed over my legal rights to the stepfather, the adoption of said child was finialzied approx one year ago. Is there any said amount of time as to which she cannot attempt to claim these expenses from me?

Until the court ordered your parental rights and responsibilities terminated (which most likely was the same date the adoption was final) you were legally responsible for child support. Under the Family Code there is NO limitations period on collecting back support owed once ordered. There is, however, a three-year limit from the date of filing a claim on how far back you can go asking for back support orders. So if she files now and adoption happened a year ago in August 2010, she can recover back support from August 2008 to August 2010.
I disagree with the previous answer. There is no limitation on the time to collect child support. However, it may be limited by the agreement that you had when you agreed to terminate your rights. Good Luck, Pat McCrary
