If a mother and father have no legal custody, can one be convicted of parental kidnapping?

California law prohibits one parent keeping children from the other parent during the time they have the right to custody of the child. Prior to a court order both parents have equal right to custody of their children. Even if the parent taking the child and keeping the child from the other parent is not convicted, that parent could be at a significant disadvantage in a custody hearing.
