mother gained custody by false dv claims
she hid kids for 8 months. i got them from cps when mother was incarcerated. i put them in scool. moved to n.y. after scool year. she filed divorce and custody papers on grounds of dv and child endangerment. she filed emergency restraining order. we were 3000 miles apart. she filed forged service of restraining order, then coerced me to call her with police present. judge claimed jurisdiction of case for violation of r.o. my kids lived with me in n.y. for 6 mo. prior. can i have jurisdiction of case brought back to n.y.? she has also been filing other false and forged documents with the court keeping me from attending hearings. i need to return to n.y. because my father is dying. how can i make this injustice stop? d.a. office is helping her, and wont return my calls. d.a.,judge, flf, womens rights advocacy group, mediator all involved in conspiracy against me. i can prove it too, but nobody is listening. help me please!

Cases such as this are complex. As a general rule the state in which the children lived for the last six months is the children's home state. There are however, several exceptions to this rule. You should consult with a New York in regard to filing an action in New York. This should be coordinated with a California attorney. Then you may be able to convince the California court to defer to the New York court.
