Legal Question in Family Law in California

Mother leaving out os state

My husband has 70% custody of his 2 daughters from his prev marriage. They have been divorced now for over 8 years. She is now moving out of state (Nebraska) to be with her boyfriend. What are the standard visitations for an out of state parent? She says she gets all summer winter and easter break, is that true? Also, she is court ordered to pay child support and has never given my husband and children a dime. Now she wants to go back to court to get these visitations that she claims she rightfully deserves. What should we do? According to my step-daughters, she has also been asking them if they would like to go live with her in Nebraska, does she have a chance?

Re: Mother leaving out os state

she'll probably get about 1/2 of summer, spring break, 1/2 of winter break, and one 3 day weekend each month. she'll probably have to cover travel expenses. this could change depending on the age of your step-daughters.

file a petition for contempt of court if you'd like to enforce the support orders. better yet, open a DCSS case and let them pursue it for you.
