Legal Question in Family Law in California

my mother is still married to my dad but they seperated and she got with my little brothers dad 12 years ago they arent together anymore but he moved back in because my little brother is bipolar and it was harder on him to know his father was homeless so my mom allowed him back into her home as long as he paid 300 dollars a month but he has hit my mother and pushed her and the cops said they cant do anything and that its his home to but its not my mom owns it and he has also started doing drugs in our home what can we do to make him leave? they say i have no rights is this true?
