Legal Question in Family Law in California

I am the mother of a 3-month old baby and have just kicked her father out of the house for being unfaithful and lying about being at work to avoid helping with the baby at home. We are trying to avoid going to court and I want the baby to be able to spend time with her father. We have made a tentative verbal agreement for him to take her on weekends for now, but I am breastfeeding still and do not want her gone for more than one overnight per week. He thinks that I should let him take her much more often than this but it will hurt my ability to breastfeed. Is it a good idea to let him take her or will that negatively affect me later if we end up going to court? If he refuses to give her back at the end of the weekend, what kind of recourse can I take? I am worried about letting him take her but I also don't feel right about keeping her away from her father either.

Developing a parenting plan for your child is an evolutionary thing. Many arrangements can be made where breastmilk is made available for the child so there can be longer periods of time for the father to spend time with daughter. Please meet with an experienced family law attorney to explore your options and develop court orders for the parenting plan.
