Legal Question in Family Law in California

Hello- My mother passed away a few years back and when she passed, her boyfriend payed for her plot as well as her head-stone. Her boyfriend would not let our family have anything to do with the funeral and on the day of our funeral to our surprise he put his last name on here head-stone. He also put his name as her husband on the death certificate....they are not married. When we asked him to change the name, he refused. Is there anything I can do to get the Head-stone changed to her REAL last name??? The bastard has also been collecting from the state on her death! Please help! If it makes any difference she is in Montclair California. Thank You

Your situation is problematic. The fact that he was her boyfriend did not give him the right to her remains, and it appears that he did so by misrepresenting himself as her husband. He also should not be collecting based on a fraudulent claim that he was married.

I suggest you speak to an attorney in depth about this.
