Legal Question in Family Law in California

My mother is recently separated from her spouse. Both owned a property. Spouse lives on property and not making payments on mortgage. How does my mother relinquish all rights to property so that if house get foreclosed it doesn't effect her?

Unless your mother can somehow get her name off BOTH the loan and the title, unfortunately, she will be affected by any sort of foreclosure. She could, in the alternative, file a motion to seek exclusive use of the home herself and make the payments until other arrangements can be made to sell it.
