Legal Question in Family Law in California

mother not showing up for scheduled times

we have a 3 year old that is scheduled to go to her mother's tuesday after (my)work and saturday morning thru Monday morning. i am required by the court order to drop and pick up my daughter for all visitation. she regularly disappears and when she does come back into the picture she is a new house. she never gives me the address to drop off our daughter. instead she arrives in unknown vehicles and takes her to an unknown address. what can i do? i do not know where my child is going anymore.

If you have asked for an address and she refuses to give it to you, you will need to go to court and ask the court to order her to provide you with an address and phone number where she can be reached while she has your daughter.

It sounds as if she is on drugs. You need to go ex parte and cease her visittion rights until she can show that she is fit. Contact me directly.

Re: mother not showing up for scheduled times

You should file an ex parte motion requesting an order that mother provide an address prior to the visits, and if she misses a visit that there visits are shortened until she has 5 or more consecutive visits. Then her visits can be restored to the present level. It is not fair to a 3 year old to have such erratic visits.
