Legal Question in Family Law in California

Mother-in-law

Mother-in-law is giving gift of 12,000 per year to my husband in his name only as a gift to reduce her estate with stipulation that he not touch money until her death. Is she doing this to keep me from having access to the money. Why am I not included. Am I ever entitled to this money?

Re: Mother-in-law

This is her money and she is giving a gift to her son. She can make any stipulations that she wants. The money is then his separate property. When he has access to that money he can share that money with you if he wants to share it, which is fairly normal. However, since you have ask the question I would bet that there are issues in your marriage with respect to money. Good Luck, Pat McCrary
