Legal Question in Family Law in California

Re: Motion of Motion and Motion To Be Relieved As Counsel-Civil. My attorney doesn't communicate with me on a regular basis with a short e-mail letting me know the status of my file. When I ask her a question regarding my case, she feels I am challenging her and then she serves me with a motion to be relieved as counsel. We filed an order to show cause and we went to court. She said she would be in contact with me in a week to sign the stipulation. I sent her $200.00 payment for Oct late, as I called to inform them. And I paid the $200.00 payment for Nov early. Now, she has sent me another Notice of Motion and Motion to Be Relieved as Counsel-Civil with a court date to be relieved as counsel. What are my rights? May I request my final bill and pay her so I don't have to go to court and pay her driving time, etc? So far, I have paid her about $4,000-$5,000 and I'm not sure what I owe her at this point (6,000-$8,000) because I didn't get a statement this month or last month. What are my rights? I am a single Mom and I need the child support immediately. I don't think she has done anything with my divorce because she doesn't communicate with me.

Yes, you can simply go to her office and sign a Substitution of Attorney form. You have an absolute legal right to your file which she must provide to you in a reasonable amount of time. And you may also demand your final bill. Good luck!
