unless there is a court order forbidding it, you and the kids can move anywhere you want.

Re: Can I move my childern out of the state

You can move your children out of state and legally there is nothing to prevent you from moving, however, California is a no fault state and the court will award custody of the children to the parent most likely to see that the children have frequent and meaningful contact with the other parent. By moving out of state without his or the court's consent may suggest to the court that you are not going to allow your husband frequent and meaningful contact and the court could order the children returned to the state pending resolution or give him custody. Go see an attorney where you can lay out all of the facts and get some good advice concerning your next move. Good Luck, Pat McCrary
