Legal Question in Family Law in California

move away request

my daughter is 15 and refuses to go over her dads every other weekend anymore, due to rude remarks from her dads wife, I've tried to dicuss with him, but he calls my daughter a liar, he never calls her. They have 2 children together and he inherited 2 step children all underage. He started to agree when I mentioned I'd like to move to Idaho where I could provide a life style similar to what he provides his 4 children, but now its gotten ugly so we are going to court and now after 14 years this will be my first visit to ask for increase for support, had he been civil it would not have come to this. My main question is...my daughter wants no part over there she says he doesn't even talk with her she just goes to soccer games every visit and stays in her room, when we tried to ask him to meet here for some one on one he said no. Do you think I will be able to move away do to these circumstances?? I currently get 500.00 a month and per the dissomaster it will now be over 1,000/mth. You would think he would just work it out between us, but has not been the case. Do the courts listen to a 15 year olds voice?

Re: move away request

The court will give strong consideration to the desires of a 15 year old, but most judges that I've been in front of would stop short of terminating visitation unless there is a danger to the child. You should talk to an attorney about getting an order to move out of the State. It will take a while and is complicated, but in the long run, based upon what you have said, you should get permission.
