File a motion requesting this move. I urge you to meet with an experienced family law attorney to explore your legal options.

You should not take the children out of state without either written permission from the father or order of the court granting you a move-away order.

The question is impossible to answer without reveiwing your current custody order. If the other parent does not agree, in writing, for the move, probably you will need to file a motion for the court to permit the move. That motion usually requires several months so you need to start right away. You may want to review the case of "F.T v. L.J." if you do a search of "california law F.T. v L.J." you will find that case an it will give you a good idea of what the judge will be looking at. You will note that I was the appeal attorney on the case. You should have an experienced attorney handle the motion for you. It can have grave consequenses if not handled properly and the move is denied.
