Legal Question in Family Law in California
Can I move out of state?
I am currently in the middle of a custody case for my 3 yr old son. Currenly, there is no permanent order, although I have my so 80% of the time. I cannot afford it on my own in CA and am looking to move out of state to CO where I have family and friends. I have been pre-qualified for a home in CO and would only need to get a new job. this would give my son and I am much better life. What steps do I needto take in order to proceed with moving?

The easiest way is to get the other parent to agree. Absent that, which is a lot to ask for, although I have seen it happen, you will need to secure a moveaway order. This will usually require a 730 evaluation, which is quite expensive. My rates are quite reasonable and I offer free consultations.

This issue needs to be addressed in your custody case. It makes the case what is called a "moveaway case." If you and the child's other parent do not agree, the court will decide what custody arrangement is in the child's best interest. The court may order a custody evcaluation of some kind to help it make this decision.
