Legal Question in Family Law in California

Move out of state.

The mother of my two children and I were never married. We are currently married to other people. We have never gotten a court order for anything. I have given her money on a regular basis and visit with the kids. She had mentioned to me about moving out of state some time in the near future. Can she move out of state with the kids without my permission or can I stop her? If so I would like to know how. Thank you in advanced for your time.

Re: Move out of state.

You can try to stop her if there is not already a court order or parenting plan in place stating that she can move the kids out of state. If you feel strongly about this issue and cannot work out of state visitation, you can file an Order to Show Cause to have the judge rule on the matter. Please consult with a family law attorney in the area where your children reside.

Assuming that the child is in California, in a general sense you can go to court to prevent the move away. You will need to act quickley!
