Legal Question in Family Law in California

I want to move out of state to N.V.. im in CA right now ...my schooling is in NV and am tryin to make a better life for my kids since he gives me no money...I was maried in NV and have an address in NV... but i've been living in CA for sometime now..... I have 3 kids and want a divorce... my ex wont talk to me unless it threats or trying to scare me into coming back to him and I know he will try to control me and make me stay in CA just to make my life miserable.. I want to seek a restraining order also but dont know if that will prevent me from moving... its not like the move is far from where i am now.. its about 4 hours away so i would be willing to drive the kids out for visits.. even though he sees the kids once a month and i think thats so he can come to the house and harrass me and try to check on me.. ... since i was maried in NV can I move there and then file for divorce and custody or do i need to file in CA and ask for permission to move....

Any moveaway whether it is 1 hour ot several hours is a big deal for the courts. In light of a divorce, you would need to get permission from the court to move away, since that will inevitably make visitations much harder. Many factors would come into play such as who is the primary caretaker and what is the custody visitation schedule. If you move away without his consent he may contact the police or file paperwork in court to get a court order making you come back. You should therefore get consent from him before doing such a move away.

To add to the above answer, you should know that the history of your parenting time share will play a big role in whether or not the court will approve the children's move. If the father has had a history of minimal time share with the children, then the court would be more inclined to support the move as long as you make adequate arrangements for the children to have contact with their father. If there was domestic violence in your relationship, this will be an important issue to call to the courts attention for your protection as well as the protection of your children.
