Legal Question in Family Law in California
I want to know if I am able to move out of state with my son. A little background, my sons father has been convicted of felony DV against me and willful harm to a child. He has violated his probation and is back in prison for 2.5 years on the violation. There is a no contact order in place for the next 10 years, at that time my son will be 15. He has not seen my son since he was 2 years old, and has never paid a dime in child support. I have not bothered to file a request because I know I will never see anything. He currently owes $300k on 3 other children. Being a single mother with no child support it will be less financial draining on me to move out of California with my son. Question is can I just move? Do I have to go to court? Do I have to let him know? How should I go about this? I would like to move asap. Thank you!

Because of the DV and his current incarceration, it seems quite probable the court would permit the child's relocation if you sought court orders modifying the current parenting contact order.
