Legal Question in Family Law in California

I want to move out of state with my wife and step child, my wife put my step daughter dad on birth cert she is now 8 and has not had phyical contact in over a year only phone calls with him they have no custody agreement he does not pay any child support. Can we move with out telling him or can he stop use from moving out of state

You do not mention if an action has been filed with the court. If there are no court actions pending and no custody or visitation orders were ever granted, you can relocate out of state and there is nothing the child's father can do about it. If an action is pending and/or orders were made, you need to file an Order to Show Cause to move away with the child. Good Luck.
