Legal Question in Family Law in California

I moved back to California in 2011 from Nebraska my husband is still in Nebraska, Can I file for diovrce in California or do I need to file in Nebraska? And which state laws do I need to follow, in this manner, been separted of over a year.

Once you have lived in California for six months and in the same county for four months, you can file in California. If you have children, however, if they are in Nebraska, then the California courts will defer jurisdiction to Nebraska if your husband files anything there. Also, you will have problems obtaining personal jurisdiction over him and/or any assets in Nebraska, unless he voluntarily proceeds in court here, or he comes here and is served with the divorce petition while here in California.
