I just moved to california (military) can I divorce my husband (he is military) and move back to home state with child to Washington state?

Probably not in California. Even if you meet the residency requirement of living here for six (6) months, a divorce court in California may not have personal jurisdiction over your husband if he has never lived in California, and has no ties to California. You would have to have your husband served with the divorce papers, and he could hire an attorney to file what is known as a motion to quash service of summons based on a lack of jurisdiction. I suggest speaking to a competent family law attorney, before running off and wasting time and money doing something that may be dismissed.
