Legal Question in Family Law in California

I moved to Concord, California on December 26th 2010 with my three children. Since I have to be a resident of California for 6 months to file for divorce would that actual date be June 26th 2011? I am searching for legal representation so when I choose a lawyer how soon will they be able to start the documents? How can I find an affordable lawyer and/or one that can take monthly payments or is that even possible?

If you moved from outside California, then yes, June 26 would be the earliest you could file for divorce in Califorina. How soon a lawyer can start on the documents depends on their office workload, but 6/26 would be the earliest they could file anything for you. There are a number of ways to make legal representation in divorce bearable (I doubt anyone would call us lawyers "affordable"). In appropriate circumstances limited scope representation is not only possible but favored for family law. It allows the client to do as much of the work as they can handle themselves, and only pay the lawyer for the work on the case the client does not feel competent to do. Some people prefer to make their own court appearances, and have the lawyer do the drafting, for example. Others do most of their own written work, with final polish by the lawyer, and then have the lawyer be the face in court. There are many variations, as well as other options if there are any significant assets, or the other spouse is in a position to contribute to your fees due to an imbalance in incomes.
