Legal Question in Family Law in California

Moving Out

I need advice on Moving Out. My wife is trying to force me out telling me to leave. We live in an apartment and I need to know my rights. She makes at least $1,000 more a month than I do and I have no financial resources to move at this time, as I have recently begun a new job. Niether one has filed (yet) but what happens if she does? Do I have to leave and go a park bench?

Re: Moving Out

It would probably take her at least 30 days to get a court order and the judge may not grant the request unless there has been violence. If you moved out you may be entitled to spousal support or funds from her in order to help your transition. Good Luck, Pat McCrary

Re: Moving Out

no one has to leave unless they get a court order which can only be after a hearing and a showing of good cause.
