Legal Question in Family Law in California

Is moving with my child out of state concidered kidnapping?

I had a baby 3 months ago. I live with the man that I believe is the father, although we have not had an official paternity test. I wish to leave him and move to my parent's home in North Carolina. If I were to do this, would it be concidered kidnapping?

Probably not but more information is needed. Does he object to you taking the child? The child has a father and if this guy is the Dad get his permission and if he doesn't give it file a motion. While you are at it, get child support.

Unless he obtains a court order forbidding it, you are free to move the child anywhere in the world you want to.
