Moving a child out of state

I am separated from my husband and we are currently sharing custody of our 3 year old daughter. At the current time, I am unable to afford the cost of an attorney to get a divorce and to have a custody agreement drawn up, My question then is, "Is it possible for me to move out of the state with my daughter without having a custody agreement in place?"

Yes, you are allowed to move out-of-state unless there is a court order preventing it. However, if you move out-of-state without getting an order yourself than you run the risk of him going into court in getting in order after you've moved away and are unable to respond to it. Check with the family law court in your local area. Many family law courts have clinics and volunteer attorneys who assist people in do-it-yourself divorces. Also, if your husband makes sufficient income, is possible to get a court order having your husband pay your attorney fees.
