Legal Question in Family Law in California
Moving children abroad from California
I have 2 kids from my previous
marriage, they live in the US, I now
live in the UK full time. I share joint
custody with their mother, who has
full physical custody of them. They
are currently on their summer break
in the Uk and they have both arrived
saying they have no intention of
returning to their mother in the US.
The divorce and custody was settled
in Ca but they have just been moved
to PA. My ex has no house, only a
rented holiday cottage, no job and no
schools for the kids. I have discussed
this at length with both kids and they
tell me their mother is near to a
nervous breakdown. They currently
visit me every major holiday in odd
years and 6 weeks every summer. I
fly them to the UK for each visit. I
provide the kids with a safe, secure
and comfortable home whilst they
are with me, and I am now capable
of having them to live with me full
time. The kids have contacted their
mother via email but have had no
reply, we have also tried her cell but
get no answer. Where can I go with
this, can I petition a change of
circumstances and petition the court
for physical custody. I am concerned
for their welfare by the stories both
relay to me. Help!

If it has been less than six months that they moved from CA, then CA still has jurisdiction. Contact me directly.
