moving children to CA.from ID

my ex and have 50/50 of our three children, i just moved to ca but they are in their fathers hm in id. i want to bring them to live with me and him having visting rights. if i sued him to get the children do i have a chance or, a big fight ahead of me.they have said they want to live with me and are not happy with him.

ID has jurisdiction over the children, if you can't reach an agreement with the father you have to file a court action there. I am a CA lawyer, and don't know what the law on "move aways" is in ID. In CA, it is complex and basically has to do with a court determination of the "best interests of the child(ren." That determination includes consideration of the child(ren)'s wishes, but requires a look that basically compares what would be the situation with you and what would be the situation with him? What's better for the children. Move aways can pose significant court battles.
