Legal Question in Family Law in California

Moving Children

My relationship with my ex-wie is quite strenuous; we do not ever get a long. My ex-wife called me one night in January and told me that she was moving the children to Arizona. We have joint legal custody of the children with her having primary physical custody. She didn't give me any dates nor any information regarding where they were moving. I tried calling my children a week later and their phone had been disconnected. I called their school the next day and was told that my children had been withdrawn several days later and that they didn't have any forwarding information, although I am not sure if they could give me that info any way. I went several weeks without knowing where my children were. Every one I talked to said that all I could do was call her family and friends and try to find them. After a few weeks, I was able to find them. My ex-wife's father had them in his custody while she was still in California for another month sorting things out. It seems joint legal custody doesn't really mean much. I have though filed paperwork and it was ordered that she will have to notify me at least 180 days prior to any move, but what if she doesn't again? It just doesn't seem fair.

Re: Moving Children

Now that you have a court order, next time report her to the police for child abduction and request an amber alert be issued. That should get her attention.
